Worst Company for Customer Service: Comcast

Worst Company for Customer Service: Comcast When we asked you which companies were the worst at customer service, we expected to hear all kinds: tech companies, communications companies, banks, retailers, restaurants. We didn't expect you to weigh in so heavily with communications companies though, most of which have virtual monopolies, so they get away with whatever they choose. After we collected your nominations, we looked at the five worst companies for customer service, and put them to an overall vote. Now we're back to crown the worst of the worst.

Worst Company for Customer Service: Comcast Voting was tight all weekend, and many of you straight out noted that deciding which company has the worst customer service was more difficult than choosing the best of any category. In the end however it was Comcast that took the top spot with over 32% of the votes cast.

Behind Comcast in second place was PayPal, taking the silver with over 22% of the overall vote. AT&T made a respectable showing in third place, pulling in over 20% of the votes cast. The real fight was for fourth and fifth place, which was decided by just over 100 votes: Time Warner Cable edged out Verizon for fourth place with the former earning close to 13% of the overall vote, and the latter pulling in closer to 12%.

The Hive Five is based on reader nominations. As with most Hive Five posts, if your favorite was left out, it's not because we hate it?it's because it didn't get the nominations required in the call for contenders post to make the top five. We understand it's a bit of a popularity contest, but if you have a favorite, we want to hear about it. Have a suggestion for the Hive Five? Send us an email at tips+hivefive@lifehacker.com!

Gold Fields' KDC East miners yet to resume work

JOHANNESBURG (Reuters) - Gold Fields said on Tuesday striking workers at its KDC East operations in South Africa are yet to return to work despite the company issuing an ultimatum for the employees to resume work or face dismissal.

South Africa is struggling to resolve violent unrest that has poisoned industrial relations and marred its image overseas.

"So far we have no turnout at KDC East but the final deadline is this afternoon," said company spokesman Sven Lunsche.

He said the company would provide another update at 4:00 p.m. local time (1400 GMT). About 8,500 workers at the KDC East were issued an ultimatum to start returning to work with the night shift on Monday and the morning and afternoon shifts on Tuesday.

With the government now pressing miners to return to work, more companies are resorting to hard-ball negotiating tactics to end wildcat strikes. Some have been successful.

AngloGold Ashanti Ltd, the world's No.3 gold producer, told striking South African miners on Monday to return to work by Wednesday or face dismissal.

Anglo American Platinum, the world's largest platinum producer, was the first to take a stand, sacking 12,000 workers at its Rustenburg operations earlier this month.

Amplats' Rustenburg mines have been shut since Sept 12. It said on Thursday it would delay the dismissal process at Union and Amandelbult, where it employs 20,500 people. It also said it was open to discussing the reinstatement of the sacked workers with unions.

The strikes spread into other mining industries after starting in the platinum mines. At Lonmin Plc's Marikana mine in Rustenburg police shot dead 34 miners in one day in August, the most violent police action in South Africa's post-apartheid history.

A government-appointed commission investigating the "Marikana massacre" heard opening statements from police, unions and Lonmin on Monday.

Computer viruses 'rampant' on hospital medical devices, say ...

(NaturalNews) All the technological advancements taking place within the medical system today are supposed to make it easier and more efficient for doctors, nurses, and hospital staff to monitor and assist patients. But according to a number of medical device experts that spoke at a recent meeting of the National Institute of Standards and Technology's Security & Privacy Advisory Board, hospital medical devices are often so infected with viruses and malware that their reliability and effectiveness is questionable at best.

Just like personal computers that are constantly at risk of becoming infected with viruses, spyware, malware, and other harmful files, medical devices that compound intravenous drugs and nutrition, for instance, or that monitor women with high-risk pregnancies, are also at risk. Because of their proprietary nature and narrowly-specified license and approval guidelines, medical devices are actually more at risk of catching computer viruses because they are often outdated, unprotected, and unable to be modified or upgraded.

"Conventional malware is rampant in hospitals because of medical devices using unpatched operating systems," says Kevin Fu, an expert in medical device security and computer scientist at the University of Michigan and the University of Massachusetts, Amherst. "There's little recourse for hospitals when a manufacturer refuses to allow OS updates or security patches."

This refusal by manufacturers to maintain hospital equipment with the latest anti-virus and malware protection software is largely a result of fears over how the U.S. Food and Drug Administration (FDA) will treat updated products within the regulatory paradigm. There is much confusion, in other words, about how already approved and regulated medical devices are to be properly maintained and updated with respect to the law, which is putting patients at serious risk.

"We worry about situations where blood gas analyzers, compounders, radiology equipment, nuclear-medical delivery systems, could become compromised to where they can't be used, or they become compromised to the point where their values are adjusted without the software known," adds Mark Olson, Chief Information Security Officer at Beth Israel Deaconess Medical Center in Boston, which has seen its own share of infected medical equipment.

In many cases, hospitals routinely have to shut down certain medical devices for days at a time in order to get them cleaned up, as well as to ensure that they have not also infected the hospital's private intranet system. Once a particular machine is back in order, another one typically requires service as well, which creates a never-ending cycle of having to continually disinfect vital hospital equipment of potentially disastrous software bugs.

The FDA is reportedly in the process of reviewing how it handles software updates for approved medical devices, but the problem is expected to continue indefinitely until a comprehensive workaround is effectively implemented. In the meantime, patients will have to simply hope that technology staff are regularly monitoring medical devices to ensure proper functionality, and quickly addressing any problems that might arise.

The problem is also being exacerbated by clinicians who bring their own devices in to work, including tablet devices and smartphones that easily link up to the hospital network. Though it is often more convenient for doctors and nurses to use their own devices rather than official equipment, the risk of spreading technological viral infections increases as a result.

Heidi Montag wouldn't repeat extreme surgeries

John M. Heller / Getty Images file

By Jesse Spero, Access Hollywood

Heidi Montag?s life has taken a drastic turn over the years. After skyrocketing to fame on ?The Hills? and making headlines for undergoing 10 plastic surgery procedures in one day in 2010, the former reality star is happy to be living her life out of the spotlight.

VIEW THE PHOTOS: From On-Set Romance To Real-Life Love: Hollywood?s Hottest Co-Star Couples!

The 26-year-old stopped by "Access Hollywood Live" on Thursday, where she dished about her now infamous choice to go under the knife and come back up with a whole new look. But does Heidi regret the cosmetic work she had done?

?I would never do it again and I never recommend it for anyone,? Heidi told Billy Bush and Kit Hoover.

VIEW THE PHOTOS: Stars Who Have Gone Under The Knife

?I was definitely way in over my head. I?m glad it worked out and you can?t really reverse time,? she said of her decision to undergo numerous procedures. ?I kind of wanted a few enhancements and then it kind of got out of hand. I wasn?t told really the repercussions and what would happen, emotionally and psychically and the pain I would be in. I was kind of in shock.?

Heidi told Billy and Kit that she has not gone under the knife since and doesn?t think she?ll have more plastic surgery in the future.

?I haven?t done anything. I?m not sure if I would have done anything again,? she explained. ?I just focus now on being healthy, alive and strong. If you?re not beautiful inside it really doesn?t matter what you look like outside, and I think I kind of lost track of that.?

VIEW THE PHOTOS: Heidi Montag & Spencer Pratt

Adding, ?I should have just been reflecting on my heart.?

Heidi also opened up about husband and reality TV partner in crime, Spencer Pratt, who was not happy about her choice to have the surgeries.

VIEW THE PHOTOS: They Dated? Surprising Former Couples!

?He was very against it. That was a big issue in our marriage,? she told Billy and Kit. ?[But,] we?re good, we?ve been married for four years and we?ve been together for six?-- in Hollywood that?s ancient! Until death do us part I would say. I honestly love him more and more every day, I laugh more, we enjoy each other more, especially taking a step out of the spotlight. We?ve really been able to enjoy each other without all the chaos.?

Heidi, who is hosting the third anniversary party at Crazy Horse III in Las Vegas on Friday, does have one regret about not being in the spotlight.

?I only miss the money,? she admitted. ?If we would have saved our money, it would have been better.?

She said that expenses like ?clothes, hair and makeup, managers, publicists, agents and lawyers? took a toll on their bank accounts.

But how much does Heidi estimate that she and Spencer lost over the years?

?I?ve never really counted, so I?m not sure [how much we lost], a lot ... over a million or so,? she estimated.
The former reality star said she now lives in a property owned by Spencer?s family, which has helped the pair save money.

?I?m eating and healthy ... a lot of our expenses are minimized,? she told Billy and Kit, explaining that Spencer could have a new career in his future, possibly in politics. ?It?s his last semester at USC for a political science degree ...?I?m not sure if he wants to go into politics, but I think he?s interested in certain areas. He?s more of a behind the scenes kind of guy these days.?

Looking back, Heidi said she and Spencer lost their way during their rise to fame and after having ?a self-awakening? moment, they are back to their former selves.

?I?ve really just taken these years since ?The Hills? and kind of been on my own journey? we both just kind of stepped back and have been able to reflect on who we?ve been, where we want to go and who want to be and what we want in our lives and it wasn?t the path we were going down. So we just kind of changed back to who we originally were,? she told Billy and Kit. ?We?re very grounded and humbled and money and fame and the fast life, you don?t really know how you?re going to react to it. I certainly never thought I would become the person that I was.?

Adding, ?It was quite the whirlwind and I?m happy to be out of it.?

Imagine the Drunken Emails You'll Send With a Beer Can Keyboard [Video]

For really no other reason than they could (and to probably sell booze) the folks over at Robofun created an Arduino-powered computer keyboard that uses cans of Staropramen beer instead of plastic keys. Users at the Webstock conference where it was unveiled simply had to gently tap each can like they were using an on-screen keyboard to register a keystroke. More »

Dempsey's 2 goals help send US past Guatemala 3-1

KANSAS CITY, Kan. (AP) ? Clint Dempsey is precisely the kind of scrappy player that Jurgen Klinsmann covets on his teams, an attacker who is willing to throw his body around for the greater good.

On Tuesday night, the rest of the United States team played just like him.

Dempsey had a pair of goals and assisted on Carlos Bocanegra's equalizer, and the U.S. finally showed some of the gritty, proactive style Klinsmann has been preaching to rally past Guatemala 3-1 and reach next year's final round of World Cup qualifying.

"They understood the moment," said Klinsmann, who has eschewed the defensive style embraced by former U.S. coach Bob Bradley for one predicated on always moving forward.

"We expected a very difficult qualifying campaign, and that's what this is," Klinsmann said. "We made clear we're the number one team in this group and the next round will be harder."

Facing their first elimination game in qualifying since 2000 and only second in 23 years, the Americans needed merely a draw to advance to the six-team finals in North and Central America and the Caribbean. The final round also will include Mexico, Costa Rica, Honduras, Panama and Jamaica.

After Carlos Ruiz put Guatemala ahead in the fifth minute, Dempsey set up Bocanegra's goal in the 10th minute, then scored in the 18th and 36th to help the U.S. (4-1-1) ? seeking its seventh straight World Cup appearance ? top its semifinal group with 13 points.

"We're excited to get to the next round," said Dempsey, whose 30 international goals are tied with Brian McBride for third-most in American history. "But we know we need to step up our game."

Guatemala, which has never appeared in a World Cup, needed only a tie to advance, but was eliminated when Dane Richards scored two goals late in the second half in Jamaica's 4-1 win over Antigua and Barbuda. Guatemala and Jamaica were both 3-2-1 for 10 points apiece, but the Reggae Boyz overtook Guatemala on goal difference, plus-3 to plus-1.

Guatemala coach Ever Hugo Almeida declined to attend a postgame news conference.

"This was my last game," the 33-year-old Ruiz said. "I want to thank all the team, my family, my fans in Guatemala for all their support. It hurts not to go to a World Cup as a player but I will try to be with my national team in any other ways."

The U.S. dictated the pace from the opening minute, appearing far more aggressive than it did while struggling to a 2-1 victory over Antigua on a muddy cricket pitch last Friday.

Still, Los Chapines caused tension when they scored in the opening minutes.

Jose Contreras took possession in the midfield and sent a looping pass ahead to Ruiz, who managed to beat Bocanegra to the ball as Geoff Cameron was caught upfield. Ruiz rounded goalkeeper Tim Howard and side-footed the ball into the goal.

As if a harbinger, Ruiz appeared to hurt himself seconds after scoring.

He reached out to steady himself on the electronic signage near the field, and may have sliced his hand. He grimaced and immediately began shaking it while a trainer rushed out to tend to him.

The tying goal came just a few minutes later.

Sporting KC midfielder Graham Zusi, playing in his home stadium, sent a corner kick arcing into the penalty area, and Dempsey got just enough of it at the near post to redirect to Bocanegra, who was left alone by Manuel Leon near the far post and easily found the back of the net.

It was Bocanegra's 14th goal with the national team, moving him past Marcelo Balboa for the most among American defenders. It also generated a roar from a sellout crowd of 16,947 that would have been much larger if officials could have sold standing-room tickets.

"We were never going to give up today," Bocanegra said. "We knew were going to get goals quickly and we got three of them."

The second came after Ruiz sent a header over the crossbar, and the American came on the counterattack. The ball was pushed ahead to Eddie Johnson on the wing, and he found Dempsey cutting to the net ahead of defender Jonathan Lopez, his goal giving the U.S. a 2-1 lead.

Johnson picked up an assist to go with the two goals he scored against Antigua in his first international appearance in two years.

Guatemala had a couple of other good scoring chances later in the half, including a shot by Contreras from a sharp angle that Howard knocked away, and a breakaway on which Ruiz was called for a foul on defender Steve Cherundolo near the top of the penalty area.

Cherundolo tried to shake hands with Ruiz, who was having none of it.

"We were just discussing what we were going to do after the game," Cherundolo said, smiling.

The U.S. pressure paid off again in the 36th minute, when Michael Bradley popped a pass over the sprawled-out Jerez and Dempsey tapped the ball across. Dempsey nearly had a hat trick when he just missed on a header early in the second half.

"It felt good after we got off to a slow start," Dempsey said. "It helps your confidence to get a couple of goals."

Failing to qualify for the World Cup would have been devastating for the U.S., still trying to regain the confidence it had when reaching the 2002 quarterfinals. The final round starts Feb. 6.

"I think it's always better when you have very meaningful games and you have to prove yourself," Klinsmann said. "When there's something at stake, like a World Cup qualifier, they know they have to be spot on."

NOTES: Klinsmann said he's not sure how he'll juggle his roster between qualifying and next summer's CONCACAF Gold Cup, the regional championship. ... Dempsey received a yellow card for diving in second-half stoppage time. ... The Americans likely will play an exhibition at Russia on Nov. 14 in their final game this year. ... Bocanegra joined Cameron at center back, Michael Parkhurst took over on the left and Clarence Goodson was benched in the only American lineup changes from Friday. .. Defender Joe Corona made his first competitive appearance for the U.S.as a 90th-minute substitute, tying him to the American national team. He also had been eligible to play for Mexico. ... The Reggae Boyz needed to make up a three-goal difference on Guatemala in a victory to advance, and Richards' goals in the 78th and 88th minutes at Kingston allowed them to move forward.

Enviro News Wrap: Solar Energy Zones; NatGas-bridge fuel or Clean Energy Blockade; Disney Adopts Sustainable Paper, and more?

The Latest Environmental News HeadlinesGlobalWarmingisReal contributor Anders Hellum-Alexander wraps-up and comments on the climate and environmental news headlines for the past week:

  • Obama and Romney have very different approaches to energy and our environment. Obama is a pragmatist and realizes that we have to use all energy sources, especially in the immediate future, Romney literally said he does not care about our environment and would ignore it while in office. One of the examples of Obama?s leadership on renewable energy is how he opened up, through the Department of the Interior,?285,000 acres of public land comprised of 17 ?renewable energy zones? for renewable energy projects.
  • Natural gas is extolled as the ?Bridge to the Future.? The future is clean and renewable energy. So?what if the investment in natural gas is?crowding out investment in that Clean and Renewable future???Oil and Coal companies don?t talk about how their product is running out and how the future will?inevitably?be coal and oil free. Natural gas is a blockade not a bridge fuel, it is just another dirty energy source.
  • Some climate scientists?link specific drastic weather events to climate change. With the crazy weather the world has?witnessed?all over the globe?people think that the link is true.
  • Democrats are??progressive,? until the coal interest in their State reigns them in.? This is also part of the reason why we do not have a national policy on greenhouse has emissions.
  • The Koch brothers are buying influence in the state of Washington. The brothers want state environmental laws repealed, leaving weaker federal standards.
  • Apparently the Koch brothers were lured over to the dark side of politics by a man named Rich Fink. His name means Wealth and Being Disgraced. Mr. Fink convinced the brothers in 2009 that they were the only things standing in the way of Obama ruining America with regulation. They have taken their cause far and wide,?turning their company into an anti-Obama machine.
  • Disney was targeted by Rainforest Action Network (RAN) in 2011 for using paper from threatened forests. Now Disney is shaking hands with RAN on a new agreement to shift their paper supply.
  • People in Nigeria are suing Chevron for ruining their lives. Shell operations in Nigeria have been dirty both Environmentally and Politically.
  • You can?t guarantee that an oil pipeline wont leak or break. So let?s reduce the number of massive pipelines and not approve any more, like the Keystone XL pipeline for the Canadian Tar Sands.
  • Solar in Germany is very straightforward in cost, in the US there are extra layers of costs. In the US only half of the cost of getting solar on your home goes to hardware, profits, and labor.
  • Solyndra is trying to?sue Chinese solar panel manufacturer Suntech for unfair competition?resulting in the bankruptcy of their business. It?s getting real in the global solar panel manufacturing industry and this was kind of predictable. Why is it such a big deal that China under-priced us on goods, don?t they do that with most of our products? Why is it such a big deal now?

Strength training for the mind, body and spirit is all gain

Strength training is one important component of overall health and choosing a retirement residence with good facilities will allow you to nurture your mind, body and soul. If you had to, could you lift a 5 or 10 lb. bag of potatoes? How about unscrew the lid of a sticky jar? Are you able to lift that big, heavy casserole dish off the shelf without faltering? If you struggle to complete any tasks that involve arm, shoulder, chest or finger and hand strength, then strength training is for you. Strength training makes the human body physically stronger. Your increased strength will give you the confidence to perform daily tasks more efficiently and lessen the chances of injury. The less you have to rely on others, the more independently you can live your life and the more you can nurture your mind and spirit.

Strength training can also help:

  • Improve bone mineral density in fight against osteoporosis
  • Reduce arthritic discomfort
  • Increases sense of balance by building stronger connective tissue and increasing joint stability
  • Control blood sugar levels for diabetics
  • Increase lower back strength and alleviate lower back pain

WikiLeaks loses Anonymous allies over paywall dispute

6 hrs.

The controversial WikiLeaks service has lost what some might consider a powerful ally after the site restricted access to leaked information behind a donation paywall. The hacker collective known as?Anonymous called the paywall "wholly unethical" and has withdrawn its support.

WikiLeaks added a large element to their site on Wednesday that obscured the content and asked that visitors donate money or share the site on Twitter or Facebook. It would disappear after a set time limit, but could not be closed or skipped except by means most users would not be familiar with. Anonymous, in a document posted to their "AnonPaste" site, reports they immediately contacted WikiLeaks but the paywall was soon up all over the site.

Henceforth, their statement reads, Anonymous will no longer work in WikiLeaks' favor ? something which has put several of their own members in prison, they said. They added that they will not attempt to hack or deface the site ("We do not attack media"), though they said they?will be releasing a "detailed dossier" of WikiLeaks actions they deem unacceptable.

WikiLeaks, for its part, defended its actions via Twitter, saying "A tweet, share, wait or donate campaign is not a 'paywall.'?" Julian Assange, the leader of the organization, posted last week on the WikiLeaks site to explain the group's?need for donations in order to continue operations. WikiLeaks is involved in several suits regarding its publication of confidential documents, and the legal costs are substantial.

The paywall, or perhaps "sharewall," is still present on the site; you can see it by attempting to access any of the millions of documents?WikiLeaks has posted.

Real Estate Tips To Help You Buy The Property Of Your Dreams - First

Making a real estate purchase is a big transaction for anyone, especially first-time home buyers. It?s a massive commitment, and a significant financial risk as well, which can be stressful. The information provided in this article will help you to be as successful as possible, and should ease some of the concerns you may have.

If you are considering purchasing a property, enlist the services of a professional inspector. It will require a fair amount of money, but the advantage over having someone you know inspect the home is that you can hold a bad inspection against a professional inspector, while there is little you can do to a relative.

There are various programs for down payment assistance, and you might want to see if you qualify for them. Pairing this in conjunction with getting the closing costs covered by the seller can really minimize how many dollars you have to stash away prior to buying a home.

TIP! If you want to purchase a new home, you should first find a good real estate agent. The real estate agent you select also needs to be trustworthy.

Have your minimum down payment that?s required by your mortgage company. Without a proper down payment, you will have to pay for private mortgage insurance (PMI). That will add more money you need to pay every month to prove to the bank you can pay your mortgage.

Learn about what kinds of houses exist in the neighborhoods you?re looking to buy in. This is particularly important, because you may not want to buy the best and biggest house on the block. It will be hard to sell a larger home, because the property value will go down due to homes in the area that are smaller.

It is of utmost importance to have a good understanding of mortgage loan terms when buying a home. This can help you to save a lot of money in the long run and will provide a clear picture of what you will pay in the future.

TIP! When you are in the midst of a real estate transaction, prioritize your goals to get the best deal. Take the time to assess the challenges and find good solutions.

Using a calculator on the web helps you determine what is affordable for you to spend. These tools will let you enter your salary plus all of the money you spend. Doing this will prevent you from over-spending, as it provides you with an accurate description of what you really can afford.

Keeping an approval letter with you will make you much more attractive to your sellers. Waiting for approval can cost more and will stretch out the process of buying the property.

Hiring an an attorney who specializes in foreclosure real estate can really help to protect you from making costly mistakes. An attorney can protect your best interests should any problems occur throughout the foreclosure or pre-foreclosure process, which is often the case. Investing in a lawyer can really help to keep money in your pocket.

TIP! Before putting your money in a home, make sure that you investigate the neighborhood and its surroundings. If the neighborhood isn?t suitable, you?ll be upset with the home regardless.

When looking to purchase a new home, it is very important to avoid the trap of judging a house based on its decor. While the appearance of a home is an important factor, you also need to consider its condition and soundness of construction. Only paying attention to the home?s decor can lead to costly problems that you neglected to notice.

After reading this, are you fired up now about buying some property? Hopefully, the guidelines listed above will help ease your concerns. Now, look for different opportunities to apply the information from this article as you search for the perfect property. Purchasing real estate doesn?t have to be all that complicated. The idea of owning property is very invigorating. Just be sure to keep the cost in mind, and be sure to make the decisions

Legal battle between Bangor sandwich shops ends with a dismissal ...

BANGOR, Maine ? The Queen City?s sandwich battle is over. At least on the legal front it is.

The debate over who makes sandwiches most like the ones served at the Coffee Pot, a landmark Bangor business on State Street that closed its doors on Dec. 31, 2009, quietly rages on.

The closure spun off at least five surrogate sandwiches, including those made by the Coffee Pot Cafe at 652 Broadway, owned by Dr. Robert E. Erickson, a Bangor dentist, and The Legacy Sandwich Shop at 163 State St., owned by Bruce and Carol Guimond of Hermon.

Last year, the Coffee Pot Cafe sued The Legacy Sandwich Shop over the use of the words ?deluxe? and ?superdeluxe? to describes its sandwiches.

Lawyers for the owners of the two rival Bangor restaurants that make sandwiches similar to the beloved Coffee Pot ? a sandwich made with ham or salami, onions, cheese and vegetables ? on Oct. 1 filed a joint stipulation of dismissal in U.S. District Court in Bangor. The case will be dismissed by U.S. District Judge D. Brock Hornby ?with prejudice,? which means it can not be resubmitted in federal court or refiled in state court.

Earlier this week, Erickson referred questions about the dismissal of the lawsuit to his attorney, Anthony D. Pellegrini of Bangor. Pellegrini declined to comment.

?A dismissal with prejudice functions as an adjudication on the merits and any attempt to refile similar claims in another court, including state court, is barred,? Sean Sweeney, the Portland attorney who represents the Guimonds, said Thursday in an email. ?Accordingly, because the Coffee Pot Cafe?s complaint expressly raised issues of state unfair competition in Counts 6-10, the Coffee Pot Cafe is precluded from raising these claims again in state court.?

Carol Guimond said Wednesday that the trademark issue has been hanging over their heads since their second day of business, May 18, 2010, when they received a cease and desist letter from Pellegrini. The lawsuit was filed in March 2012 in federal court in Bangor.

?It feels like a great big cloud has been removed but there?s still damage from the storm,? she said Wednesday in a telephone interview. ?It?s been two-and-a-half years of trademark bullying and confusion for our customers.?

She continued: ?We are moving forward running our business just as we have but without the lawsuit hanging over us. Our customers have been wonderful and very supportive.?

The complaint alleged that Legacy Sandwich began using nearly identical names ? ?Legacy Deluxe Sandwich,? ?State Street Super Deluxe Ham and Salami Sandwich,? ?State Street Super Deluxe Ham Sandwich? and ?State Street Super Deluxe Salami Sandwich? ? for its own creations when it opened next door to the original Coffee Pot location shortly after the Coffee Pot Cafe made its debut.

The Coffee Pot Cafe alleged that this ?caused a likelihood of confusion or of misunderstanding? as to the source of Legacy Sandwich sandwiches and that the similarity of its sandwiches? names to those used by the Coffee Pot Cafe led some people to believe that there was an affiliation or association.

Sweeney said one of the issues that led to the dismissal of the case was that Erickson filed the trademark for the words ?deluxe? and ?superdeluxe? with the Maine Secretary of State?s Office, not with the U.S. Patent and Trademark Office, which conducts a search to see if there are other similar patents or trademarks pending. The state is not able to do similar searches to determine the uniqueness of a patent or name, the attorney said.

?A lot of restaurants, including some national chains, use these words,? Sweeney said. ?They are common in the food industry.?

The Brazilian Bum Workout by Aimie Smith | Fitness News | Fitness ...

Published on October 10, 2012 by FASTERSally ????? No Comments

Like everyone else who knows that ?working the biggest muscle group (i.e. the glutes) will have great effects on metabolism and physique?, I have always tried to work my glutes a lot. However, in?my 10 years experience in the gym, I have also noticed that the glutes are a huge contributor to all sorts of issues when not lengthened effectively?

When kettlebells came back into ?gym fashion? it was so exciting to have an exercise to really get the glutes firing. But have you noticed that so many people who work their glutes by doing their kettlebell swings normally have very tight glutes and it takes ages to see results? And the same is also true of anyone who uses ?the clam? exercise from Pilates and the Abductor machine!

Well my friends, I have a much friendlier way to get a tight tush which won?t leave you with the back ache, hip ache and other problems associated with tight glutes.

My approach is simple really ? stretch the muscle to work it! (instead of tightening the muscle to then have to sit in a stretch for 15 mins to undo all that tightening). This approach not only saves you valuable time, effort, energy and butt ache, but will also get you the tight toned derrier of a sloggi thong model! I promise this approach will get you sweating, and you?ll start noticing a difference in the shape of your derriere in just 3 weeks!

?

The Brazilian Bum Workout

In the last 18 months I having been using the Faster ?load to explode? method (i.e. lengthen a muscle to cause it to contract maximally) when training my clients, and all of them have noticed a huge change in their posterior (I have even had a few ladies who have told me their husbands are thrilled with their bottoms, which look better than when they were in their 20s!). Not only that, but the ciatica and hip and lower back issues are now a thing of the past!

So here is Angela (a client of mine), telling us her glute story, as well as an example of some of my favourite exercises for getting that Brazilian Bum?

?

?

The program demonstrated in the video above is one that I used with Angela specifically but you can try it too!

Week 1: Do each exercise in a circuit (i.e. do one exercise after the other) for 30 seconds per exercise. Perform the circuit two times. Do this 2-3 times a week.

Week 2: Do each exercise in a circuit (i.e. do one exercise after the other) for 45 seconds per exercise. Perform the circuit three times. Do this 3-4 times a week.

Weeks 3-4:?Do each exercise in a circuit (i.e. do one exercise after the other) for?60 seconds?per exercise. Perform the circuit?three?times. Do this 3-4 times a week.

?

Once you have done this work out 3-4 times per week over the 4 weeks you should see a great improvement in your rear view ;)

NY Food Truck Lunch: Mr. Smith Durger From The Trusty Truck ...

(credit: New York Street Food)

(credit: New York Street Food)

Perry, the voice behind?New York Street Food, brings you his latest review on?New York City food trucks.

Another new food truck hit the streets of New York a couple of weeks ago, and this one you should pay attention to. It?s called the Trusty Truck, and you can trust them to deliver tasty lunches at a good price.

The specialty of the house is a ?durger,? a hamburger shaped like a hot dog. They currently have 5 varieties on the menu, including a vegetarian durger made with a lentil base.

(credit: New York Street Food)

We asked what their most popular durger was, and they said Mr. Smith, which costs $6. To go with Mr. Smith, we got an order of sweet potato fries for $3.

Mr. Smith is like a bacon cheeseburger deluxe in a different shape. Although the durger is shaped like a hot dog, they split it horizontally and grill it over flames.

All the durgers are made with 100% all-natural Black Angus beef. When the durger is on the grill, American cheese is melted on top. Then it?s put on a bun with lettuce, tomato, bacon and their homemade TT sauce.

More: NYC?s 7 Best Food Truck Burgers

A durger is not quite as beefy tasting as a thick hamburger, but it?s certainly not for vegetarians. Elongating the shape helps the other flavors come through, such as the bacon and TT sauce. We would say in this format, the durger accounted for about 50% of the taste of each bite. In a traditional burger, it?s more like 75% of each bite is burger taste.

As for the bacon, we liked that it was not overly-cooked. There was still a little chewiness to it.

The TT sauce was ok, but we would have preferred ketchup and mustard on the durger, and maybe some relish too. They wouldn?t give us the ingredients in the TT sauce, but it was ketchup, mayo and some spices, although it wasn?t spicy.

We get crazy when vendors serve huge orders of fries for $4 or more. These are supposed to be side dishes that you get to complement the main course. Who can eat a big burger (or durger) and a huge order of fries for lunch? We can, but usually end up in a food coma around 3 o?clock.

More: NYC?s 8 Best BBQ Restaurants

(credit: New York Street Food)

Trusty Truck gets it right here. French fries are $2.50 and sweet potato fries are $3, and the size is manageable. We would rather have a smaller amount and pay less money than have an enormous side dish.

We?re big fans of sweet potato fries, and these were decent.?The outside could have been a little crispier, but we did have to travel a bit with the food. ?We also like a light dusting of sugar on sweet potato fries, but these were only dusted with salt & pepper.

The Trusty Truck is a welcome addition to the NY food truck scene. The word ?durger? doesn?t exactly roll off the tongue, but the food here will make your tongue and belly happy.

They are still new to the street, so exact parking routines are not yet set. The best way to find the Trusty Truck is on Twitter here?or on?our?Mobile Munchies Twitter feed. You can also find their?website here?and Facebook here.

The chef, Giovanni, told us they are still toying with the menu, getting rid of items that aren?t selling well, and bringing on new dishes. We?re really looking forward to that Holy Chipotle, Batman.
